Notification, Declaration, and Consent Form Pursuant to the Law No. 6698 on the Protection of Personal Data and Your Rights Within This Law's Scope
At Acar Ergönen Attorney Partnership (hereinafter referred to as “Acar Ergönen”), we seek to inform you regarding the collection, processing purposes, legal bases, and your rights pertaining to your personal data under the 'Law on the Protection of Personal Data' in order to safeguard fundamental rights and freedoms. Within the framework of this Law, the terms are defined as follows:
- Explicit Consent: An informed consent given freely and explicitly on a specific matter.
- Personal Data: Any information relating to an identified or identifiable natural person.
- Processing of Personal Data: Any operation which is performed upon personal data, whether or not by automatic means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination, or otherwise making available, alignment, combination, restriction, erasure, or destruction.
- Data Processor: The natural or legal person processing personal data on behalf of the data controller, upon its authorization.
- Data Recording System: The system where personal data are processed according to specific criteria.
- Data Controller: The natural or legal person who determines the purposes and means of processing personal data and is responsible for establishing and managing the data recording system.
Under this Law, Acar Ergönen acts as the Data Controller.
As per the Law No. 6698 on the Protection of Personal Data (hereinafter referred to as "PDPL") which came into effect on April 7, 2016, should our clients share their personal data with our firm to benefit from our services, our firm, in its capacity as the Data Controller, will be authorized to process these personal details within the parameters set by the PDPL.
The purposes and legal reasons for processing your personal data encompass delivering our law and legal consultancy services consistently and continuously, recording the identity, address, and other essential information of our clients, establishing all electronic or paper-based documentation to serve as the foundation for operations, and to comply with applicable legislation.
Your personal data will be used for billing/receipting, relevant reporting, our firm’s financial transactions, and also for analysis and evaluations to provide you better service. Your personal data can be collected through our firm’s bilateral agreements with clients, partners, or suppliers, our website, phone, and other similar channels, either automatically or manually, in written, verbal, or electronic forms. Your personal data may be shared, within the constraints of the purposes stated, with the parties, institutions, and organizations permitted by applicable legislation; public authorities; consultants, and organizations with whom we collaborate, cooperate, or from whom we procure services.
Excluding the exceptions stated in Article 28 titled "Exceptions" of the PDPL, as per Article 11 of the PDPL, you have the right to:
- a) Learn whether or not your personal data is being processed, b) If processed, request information about it, c) Understand the purpose of processing and whether data is used in accordance with this purpose, d) Know third parties in the country or abroad to whom data is transferred, e) Request rectification if data is processed incompletely or inaccurately, f) Request deletion or destruction of personal data under the conditions set forth in Article 7 of PDPL, g) Request notification of operations to third parties to whom personal data is transferred, h) Object to negative consequences about you that are concluded as a result of the exclusively automated processing, ı) Claim compensation for damages incurred due to unlawful processing.
Your rights can be exercised from the effective date of the regulation, October 7, 2016. Written requests regarding the application of the Law should be submitted to our law firm. However, should the realization of your requests incur additional costs, we reserve the right to charge you based on the tariff specified in Article 13 titled "Application to the Data Controller" of the PDPL.
This notification and consent form is an integral part of any contract you have signed with our law firm.
